Planning and Zoning Commission.
The Planning and Zoning Commission shall consist of five members.
- All members shall be residents of the Town.
- No voting member shall be a candidate for, a candidate-elect to, or incumbent in any elected political office, a Town employee, or a member of the Board of Adjustment at the time of appointment and throughout the term of office. Qualifications include:
- Have knowledge of and experience with the problems of rural and urban development; and
- Be familiar or become familiar with the Comprehensive Plan, the Town Code, and other development related laws, regulations, and policies.
Term of office.
- Each member shall serve a five-year term or until a successor takes office.
- The terms shall be staggered so that generally only one member is appointed or reappointed each year.
- Appointments. The Town of Ocean View Mayor shall appoint members of the Planning and Zoning Commission, subject to confirmation by a majority of Council.
- Chairperson and Secretary. Members of the commission shall elect annually a Chairperson and a Secretary from among themselves.
Vacancies.
- A vacancy occurring prior to the expiration of a term shall be filled in the same manner as a member appointed to a full term.
Compensation.
- Members may be compensated as determined by Town Council. Currently $30 an application.
Powers and duties.
- Participation in the preparation and submission of a Comprehensive Plan for the Town as directed in Title 22, Section 702(a), of the Delaware Code.
- Other duties set forth in state law.
- Reviews plans, studies information associated with applications, and recommendations made regarding land use and development related matters as requested or assigned.
- Conduct of meetings. The Planning and Zoning Commission shall adopt rules of procedure for the conduct of meetings. The Planning and Zoning Commission works with the Town Planners to respond to applications submitted for consideration.
Board of Adjustment.
The Town shall continue to maintain a Board of Adjustment and the Board of Adjustment shall consist of five members.
Qualifications.
- All members shall be residents of the Town.
- At the time of appointment and throughout the term of office, a member shall not be a candidate for, a candidate-elect to, or incumbent in any elected political office, a Town employee, or a member of the Planning and Zoning Commission at the time of appointment and throughout the term of office; and
- Members shall have knowledge of and experience with the problems of rural and urban development.
Term of office.
- Each member of the Board of Adjustment shall serve a three-year term; and
- The terms shall be staggered so that generally no more than two members appointed or reappointed each year.
Appointments.
The Mayor shall appoint members of the Board of Adjustment; and
- The Town Council must confirm the appointments by majority vote before the appointment is valid.
Officers.
- Members shall elect a Chairperson and a Secretary from among themselves.
- Members shall designate a member to assume the Chairperson's duties when the Chairperson is unable to serve.
Vacancies.
- A vacancy occurring prior to the expiration of a term shall be filled for the remainder of the unexpired term in the same manner as a member appointed to a full term; and
- The person appointed to complete an unexpired term shall have the same qualifications as members appointed to full terms.
Compensation. Members may be compensated as determined by Town Council. Currently $30 per application.
Board of Elections.
There shall be a Board of Elections,
- consisting of five (5) members and three (3) alternates, who shall be appointed by the Council at the first meeting in the month of May.
- The alternates shall be bound by all the applicable provisions of this Charter and shall attend all meetings of the Board and, if a member of the Board is absent or incapacitated for any reason, shall serve in that member's place until the absence or incapacity has ceased, having all the powers and authority, including the right to vote, and being subject to the duties imposed on a member of the Board.
Terms.
- The terms of members of the Board of Elections and alternates shall begin in May of the year they are appointed and shall expire in May three (3) years following their appointment, but not until their successors have been appointed.
- Members of the Board of Elections and alternates shall be qualified voters of the Town and shall not hold or be candidates for any elective office during their term of office.
- The Board shall appoint one (1) of its members as Chairperson.
- Should a vacancy or vacancies occur on the Board of Elections, the Council shall fill the unexpired term(s).
- The Council shall determine the compensation of the members of the Board and alternates. Currently $100 for election day; and $30 for meetings to prepare for elections.
- In addition to the qualifications set forth in this Charter, each member of the Board of Elections shall satisfy the requirements for office as set forth in Title 15 of the Delaware Code.
Duties.
The Board of Elections shall oversee the registration of voters, nominations and all Town elections. The Board may appoint election clerks or other employees to assist it in any of its duties, which may be employees of the Town.
Board of Assessments.
If the Town Council shall elect to use the assessment process provided for in the Town Charter, it shall appoint at any regular or special meeting of the Town Council three residents of the Town of Ocean View who shall be members of the Board of Assessment. The members of the Board of Assessment shall be appointed for terms of one year.
Duties.
The Board of Assessments shall be called to meet for an official appeal of an assessment any time an assessment continues to be questioned following first an unofficial appeal with the Town’s contractual Assessor.
The Board will be presented with all the facts and details associated with the assessment to reach a decision.
Compensation is Currently $50 day.
